This Application Usage Agreement ("Agreement") sets forth the terms and conditions for using the application ("App") provided by ZETECT* ("Provider") to the user ("User").
1.1. "App" refers to the mobile application ("Dancefy") developed and provided by the Provider, which allows Group Leaders to create and manage groups, particularly for dance groups.
1.2. "Group Leader" refers to a User who has the authority to create and manage a group within the App.
2.1. The User must register and create an account in the App to fully access all features of the App.
2.2. The Group Leader is responsible for managing their group and the members of that group within the App.
2.3. The User agrees to use the App in accordance with this Agreement and applicable laws.
3.1. The Group Leader is responsible for all content they upload into the App and for the actions of the members of their group.
3.2. The Group Leader must ensure that all information about group members is accurate and up-to-date.
3.3. The Group Leader agrees not to use the App to disseminate inappropriate, illegal, or harmful content.
4.1. The Provider collects, stores, and processes personal data of Users in accordance with applicable laws and the Privacy Policy, which is part of this Agreement.
4.2. The User agrees to the processing of personal data.
4.3. Group name, logo and brading can be used for dancefy Marketing purpouses and displayed on website and social media.
5.1. All rights to the App and its content, including copyrights, trademarks, and other intellectual property rights, belong to the Provider.
5.2. The User does not have the right to copy, modify, distribute, or otherwise use the App or its parts without the prior written consent of the Provider.
6.1. The Provider is not liable for any direct or indirect damages caused by the use or inability to use the App.
6.2. The Provider is not liable for content uploaded by Group Leaders or group members into the App.
7.1. The Provider reserves the right to limit or terminate the User's access to the App at any time in case of violation of this Agreement or for other reasons at the Provider's discretion.
7.2. The User may request the termination of use of the App, in which case the account and all associated information will either be anonymized or deleted within a month.
8.1. The Provider reserves the right to change this Agreement at any time. Users will be informed of changes via the App or other suitable means.
8.2. By continuing to use the App after being notified of changes to the Agreement, the User agrees to these changes.
9.1. This Agreement is governed by the laws of the State.
9.2. Any disputes arising from this Agreement will be resolved by the competent courts in Prague.
